Council has a role to play in ensuring that the community is doing the right thing when it comes to Development Compliance. Development compliance can relate to a breach of the Development Act 1993 (the Act) which could include a new activity e.g. a business operating from home that is impacting on the amenity of the area, or a structure that has been erected on the land without the relevant approval, or it could relate to remaining compliant with the conditions of approval with an existing development application.
Applicants for development approval are required to comply with all conditions associated with a development approval. The development approvals attach to the land, meaning that the rights to use the land for that purpose transfer to new owners, provided the use rights have not been abandoned. It also means that the conditions of approval remain with the land until that use ceases or changes, meaning that the conditions must continue to be fulfilled.
